Who these terms are with

Whyzit is a product of Audit AI, Inc., a Delaware corporation. These terms are an agreement between you and Audit AI, Inc.

These terms apply when you use Whyzit. When the service opens we will ask you to accept them before your first film, through the website or through the assistant you use.

What Whyzit does

You type a question. Whyzit generates a short narrated film that answers it, about one minute long.

Who can use Whyzit

You must be at least 13, and you must meet any higher minimum age that applies where you live. If you are below the age of majority where you live, your parent or guardian must agree to these terms.

You must have the authority to agree for any organization you represent.

Making a film needs an account. You make one with an email address and a password, or with Sign in with Google. Watching a film needs no account. Anyone holding a film's link can open it and watch.

Using Whyzit through another assistant

Audit AI, Inc. provides Whyzit, including when you reach it through another company's assistant. These terms cover Whyzit. That company's terms cover its own assistant.

Free films

Each new account gets two free films. A film counts once it is ready to play. A generation that fails does not use your allowance.

A follow-up makes a new film in the same chat, and it uses one film.

We may change the offer for people who arrive later, and we say so on the site before we do. We honor an allowance you already have.

The free films put you on no paid plan. A plan starts only when you buy one in settings.

Paid plans

We offer two monthly plans. Explorer gives 12 films a month for $7.99. Polymath gives 40 films a month for $19.99. Prices are in US dollars.

You pay monthly through Stripe, which holds your card details. We hold the Stripe customer id and subscription id with your account, so we know what you paid for.

Your films reset on your billing date each month. Unused films do not carry over to the next month.

A film counts once it is ready to play. A film whose render fails is not counted.

You can cancel at any time in the billing portal, from settings. The plan then ends at the end of the paid month. We give no refund for the rest of that month, except where the law requires one.

What you may ask for

You may ask questions within the limits below.

• Break a law, or help somebody else break one.
• Infringe copyright, a trademark, privacy, publicity or anyone else's rights.
• Clone or imitate a real person's voice or likeness without the permission you need.
• Make content that harasses a person, or that presents a real person as saying or doing something they did not.
• Create a deceptive endorsement, or present a film as authentic evidence of a real event.
• Create sexual content involving children, intimate images of a person who did not agree, or content that promotes violence against a group.
• Put sensitive personal information in a question, or private information about another person without a lawful reason.
• Get around our limits, resell access, or automate the service beyond the published interface.
• Break, overload or probe the service, or work around its security.

We may stop a request, or stop serving you, when a use breaks this section.

Reporting a problem with a film

Report harmful content or a complaint about your rights to help@whyzit.com. Send the film link and explain the concern.

We may remove or restrict a film while we look into it.

A film is generated, and it can be wrong

Whyzit writes and renders every film automatically. A film can state something that is false, out of date or missing important context. Images and narration are synthetic.

Do not rely on a film for a medical, legal, financial or safety decision. Check anything that matters with a source that takes responsibility for being right.

When you share a film, make clear that AI generated its images and its narration. Keep any AI label or provenance information that comes with the film.

Who owns what

You keep any rights you already hold in your question and in anything else you send us. You must hold the rights you need to send it and to let us process it.

You give us a worldwide, non-exclusive, royalty-free licence to process that material and your films, so that we can provide Whyzit. This covers making a film, delivering it through the assistant you chose, and storing it for the periods in our privacy policy. Our providers may exercise this licence only to provide those services for us. The licence ends when we delete the material.

As between you and us, you may keep and share the films you make, for your own personal use. That includes showing a film to other people and posting it.

Commercial use needs a paid plan. On Explorer or Polymath you may use a film to advertise, to sell something, or in work you are paid for. On the free films, do not. Write to help@whyzit.com if you are not sure whether a use is commercial.

Films may resemble other films. We do not promise that you hold exclusive rights in one, or that copyright protects every part of it. Our permission does not clear rights that belong to other people, including copyright, trademarks, privacy, likeness and voice rights. Check those before you publish a film.

Audit AI, Inc. owns the service itself, which is the software, the name, the mark and the look of the pages. These terms give you no right to any of that.

The service is early

Whyzit may be slow or unavailable. We may change the service or end it.

We give reasonable advance notice of a planned change that materially reduces a paid service, where that is practical. We may act at once when security or the law requires it. We explain what happens to any purchase, and we provide any refund the law requires.

Ending the service does not remove your privacy rights, or our duties for information we still hold.

No warranty

Whyzit is provided as it is. To the fullest extent the law allows, we make no warranty of any kind about it, including any warranty of merchantability, fitness for a particular purpose or non-infringement.

Limit of liability

Nothing in these terms limits a right or a remedy that your law does not let us exclude. That includes liability for fraud, for deliberate misconduct, for gross negligence, and for death or personal injury caused by our negligence. Our exclusions and our cap do not apply to any of those.

For every other claim, and to the fullest extent the law allows, Audit AI, Inc. is not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data.

For every other claim, our total liability is the greater of 100 US dollars or what you paid us in the 12 months before the event that led to the claim. This cap applies only where the law permits it.

Ending access

You can stop using Whyzit at any time. We can suspend or end your access when you break these terms, or when we end the service.

Changes to these terms

We publish updated terms on this page, with the date they take effect at the top.

We give advance notice of a material change through this website, and through an affected connector where we can. Where the law requires it, we ask you to accept a material change before you use the affected service.

A change does not alter a purchase you already made, or a dispute already underway, without your agreement, unless the law requires otherwise.

Other terms

If a court finds part of these terms unenforceable, the rest continue where the law allows.

These terms, with any purchase terms shown at checkout, form our agreement about Whyzit. They exclude no statement or right that the law protects.

We may transfer this agreement as part of a merger or a sale, and we will not reduce your rights by doing so. We tell you when a transfer changes who provides Whyzit.

Neither of us is responsible for a delay caused by something outside our reasonable control, where the law permits that. This removes no refund or other remedy the law requires.

You must follow the export control and sanctions laws that apply to your use of Whyzit. You may not use Whyzit where those laws stop us providing it to you.

Governing law

The laws of the State of Delaware govern these terms, without regard to its rules on conflict of laws. The state and federal courts sitting in Delaware have jurisdiction over any dispute.

If the law where you live gives you the right to bring a claim in your local courts, or to rely on your local law, these terms do not take that away.
